DEFINITIONS

You -
The person or company that has signed up to this package

Domain Name -
The address that your website can be accessed from

Bandwidth -
The amount of data downloaded as a result of visitors viewing webpages, images and other multimedia on your website.


TERMS & CONDITIONS

For .co.uk domain names -

We will register the domain name on behalf of you. The name is hosted by 1&1 Internet Ltd. and Schlund + Partner AG and managed by the .uk domain registry - Nominet UK. You agree that these parties have access to your contact information but all parties agree not to share your details to any third parties.

We require your name, address and telephone number. The domain registry will hold this information which is required legally and in the event of a dispute. By asking us to register a domain you agree to the Nominet Terms & Rules. You must also agree to the Nominet Dispute Resolution Service Procedure.

For .com and .net domain names -
We will register the domain name on behalf of you. The name is hosted by GoDaddy.com, Inc and managed by the .com domain registry - VeriSign, Inc.

We require your name, address and telephone number. The domain registry will hold this information; this is required legally and in the event of a dispute. You must agree to the .com and. net Registration Agreement

For all domain names -
We have no responsibility for any dispute that may arise from any domain name registered or hosted by us for you.

Cancelling the service (for customers not on the Start-Up price plan) –
You may cancel the service at any time, no refund will be issued. The charge you pay when you commence this service entitles you to exactly one year of the entire service. If you cancel you will lose everything (although yourdomainname.com/net/co.uk and your e-mail addresses will be kept if you transfer it – see below).  Everything on the website will be deleted. Please see below for the complications in cancelling your service within the first two years.

Cancelling the service (for customers on the Start-Up price plan) –
If you choose to cancel the service before the 12 months of monthly payments have been made you will have to pay the remaining monthly payments
. If you choose not to do this then legal action will be taken. If you cancel you will lose everything (although yourdomainname.com/net/co.uk and your e-mail addresses will be kept if you transfer it – see below).  Everything on the website will be deleted. Please see below for the complications in cancelling your service within the first two years.

Cancelling Implications

Domain Names are registered for one year (2 years for .co.uk names) when you begin and they will be renewed by us. If you cancel your website package you may have the domain but you must find a domain registrar or a website host to transfer it to from us. There will be a charge from the new domain registrar for this which varies by company but on average it is £10/$15.  Once it is transferred to another website host or domain registrar it is entirely your responsibility and yours to keep. If you do not transfer it the domain will be left to expire.   IMPORTANT – You will not be able to receive any e-mails at any address you had setup with us if you do not transfer the domain. Even if you do transfer it, please check with the company to see if they have an e-mail service included otherwise you will still not be able to receive any e-mails.

Service Charge -
After one (1) year from the start of the contract you will be required to pay a service charge. We will notify you of this 30 days in advance and then remind you at regular intervals until payment is made. The amount is agreed when you first sign-up to a Clickommerce package. The service charge is required to keep your website running. The service charge is for bandwidth, on-going support, updates and e-mail services. Once it is paid you will be charged it again every year. You agree that we are entitled to raise the service charge at any time, however it can be no more than 15% in two years. You agree that if the service charge payment is not made your website will be suspended until payment is made. If no payment is made within 6 months we may delete your site and/or domain name (However transferring your domain name from us before this is allowed).

E-Mail Services -
Using your e-mail account to spam or excessively e-mail people is strictly prohibited and your e-mail services will be suspended if we detect you are spamming. There is a 2 GB mailbox capacity for each e-mail account. The attachment limit for sending and receiving is 12 MB.

Payment for services -
If you choose to pay for our services over the internet - Payment is not handled by us but by PayPal and Nochex, we cannot access your credit card details. PayPal and Nochex use industry-strength encryption and security techniques to keep your details secure. We also accept payment by cheque.

Bandwidth -
There is no quota in place regarding bandwidth to your store. However we have the right to increase your service charge if your store is using extreme amounts of bandwidth. We will never suspend your website if your website is using extreme amounts of bandwidth.

Customer Support -
You agree to allow us to contact any customers you have registered on the shop personally via e-mail if there are issues regarding payment, ordering etc.

Security -
We use industry strength SSL (secure sockets layer) encryption and security measures keep your shop and customer information secure, however you agree that we will not be held responsible if the shop is hacked as a result of you not putting in place necessary precautions to keep your administrator password safe.

Payment -
As there are many different payment methods you can use on your shop and we cannot access your payment method account, it is your responsibility to ensure that you have thoroughly tested ordering on your shop and making sure you receive the correct amount of money before it is launched. You must also check that the stock decreases (if it is enabled), the correct amount of tax is calculated and charged etc.

Server Maintenance -
You agree that from time to time we will need to carry out important maintenance and updates to your shop. About 99% of time there will be a message on the shop informing customers that we are performing a system update etc. and an apology. Updates usually take no longer than 20 minutes. For longer periods of maintenance we will notify you in advance.

Shops with products of a sexual, offensive or illegal nature -
We cannot build shops for shops of a sexual, offensive or illegal nature due to restrictions from our host. Any products added which come under this will be removed, your shop may be suspended if you continue to add products of this nature.

Laws and Regulations that apply to the running of your internet shop -
You agree to comply with the Distance Selling Act 2000 and any other laws that apply to internet shops within your country. We are not responsible if you are accused of being in breach of these regulations by law enforcement agencies, trading standards agencies or The Office of Fair Trading.
